A private person was not considered liable for repayment of a credit unlawfully taken in his or her name
A private individual has, seemingly, applied to a credit company for a private loan that has been signed electronically with a login card and BankID. The loan was paid into the defendant’s bank account, but was cancelled due to non-repayment.Where the defendant has made it likely that someone else has unauthorised use of the login card and thus electronically signed the agreement in the defendant’s name, the Court of Appeal chooses to determine the District Court’s decision that there is no obligation to refund.
The credit company claimed as the basis for its action that, when the signing of the loan application was carried out with the defendant’s BankID, contractual obligations arose regardless of who signed the contract.
The credit company further argued that, since the defendant had failed to make it likely that someone else had signed the loan application, the obligation to pay was primarily based on contracts. In the second instance, the principle of condictio indebiti was invoked, where a mispayment had occurred on the basis of an erroneous belief as to the obligation to pay.Therefore, the credit company considered that there was no legal basis for the payment. Thirdly, the credit company claimed undue profit as a result of the undue appropriation of the amount of credit paid. Fourthly, the plea was made of pure damage to property, as a result of the defendant’s involvement in the unauthorised taking of a credit in his name. The credit company claimed negligence, based on lack of verification of login card and login code. This, according to the credit company, is contrary to the defendant’s banking conditions for login cards, which consequently caused damage to the credit company.
The defendant, for his part, claimed that no loan agreement had been concluded and claimed that the loss of the card came to his attention only when he was notified of the payment from the credit company. The login card was stored during working hours in a wallet that was in the locker room. On the day the defendant learned of the payment, the money was passed on to an account with another bank. When the defendant became aware of this, the credit company was immediately contacted and a police report of fraud was drawn up. The defendant argued that there was no negligence in the absence of knowledge of the loan or the use of credit amounts. The defendant has also attempted to block the login card as soon as possible. It also includes the fact that in a previous case the defendant was entitled to a claim for damages on the ground that a person was convicted of unlawfully taking the credit in question in the defendant’s name.
As a first question, the District Court examines whether there is a contractual obligation to pay. It is clear from the District Court’s ruling that the main rule is that account holders are not liable for claims arising from unauthorised use of payment instruments. On the other hand, the district court stressed that it is the holder of the electronic signature who needs to make this unauthorized use admissible. The defendant, through oral and written evidence, has succeeded in making that admissible, which is why the obligation to pay compensation is not considered to exist on the basis of a contract. The principle of condictio indebiti could not be applied when a loan agreement was concluded. The loan agreement itself creates a legal basis for the disbursement. There is no evidence that the defendant was aware of or appropriated the amount of the credit, which is why the principle of unauthorised gain is not applied. With regard to the plea of pure property damage, the District Court clarifies that the negligence which the defendant may be deemed to have shown by failing to protect the login code or supervise the login card is contrary to the Bank’s terms of use. However, these terms can only be invoked between bank and customer.
In view of the above, the claim was dismissed by the District Court.
On the same basis as the District Court, the Court of Appeal held that the payment had not been a mistaken payment, since the legal basis (contract) existed between the bank and the loan originator. Nor could the condictio indebeti be updated.
As regards unjust profit, the Court of Appeal emphasised that the defendant, as a claimant, had received a claim for damages by a District Court judgment. This is due to the fact that a person has been convicted of money laundering offences by unlawfully taking this loan in the name of the claimant. The credit company claimed that this claim for damages benefited the defendant financially, which the defendant replied that the loan amount was not available to him.The credit company has not been able to demonstrate unauthorized profit.
Finally, the Court of Appeal clarified why liability for damage to property was not incurred. The Court of Appeal then refers to the practice which clarifies when compensation for pure property damage may be awarded. The type of situation that could be relevant to the case in question is where an action was qualified as unfair (cf. NJA 2005 p. 608). The defendant is not considered to have acted qualifiably unduly in such a way that compensation for pure property damage can be awarded.
In light of this, the Court of Appeal upheld the judgment of the District Court.
En privatperson har, till synes, hos ett kreditbolag ansökt om ett privatlån som har signerats elektroniskt med inloggningskort och BankID. Lånet betalades ut till svarandens bankkonto, men sades upp till betalning då återbetalning uteblev. Då svaranden gjort det sannolikt att någon annan obehörigen nyttjat inloggningskortet och därmed elektroniskt signerat avtalet i svarandens namn, väljer Hovrätten att fastställa Tingsrättens beslut om att återbetalningsskyldighet inte föreligger.
Kreditbolaget anförde som grund för sin talan att då undertecknandet av låneansökan genomfördes med svarandens BankID uppstod avtalsbundenhet oberoende av vem som undertecknat avtalet.
Kreditbolaget anförde vidare att eftersom den svarande inte lyckats göra det antagligt att någon annan undertecknat låneansökan, skulle betalningsskyldighet i första hand grundas på avtal. I andra hand åberopades principen om condictio indebiti, då en missbetalning ägt rum på grund av felaktig tro om betalningsskyldighet. Därför ansåg kreditbolaget att det saknades rättslig grund för utbetalningen. I tredje hand hävdade kreditbolaget obehörig vinst till följd av att det utbetalade kreditbeloppet tillgodogjorts orättmätigt. I fjärde hand åberopades ren förmögenhetsskada, som ett resultat av att den svarande medverkat till att någon obehörigt kunnat ta en kredit i dennes namn. Kreditbolaget hävdade oaktsamhet, grundat på bristande kontroll av inloggningskort och inloggningskod. Detta strider enligt kreditbolaget mot svarandens bankvillkor för inloggningskort, vilket följaktligen orsakat skada för kreditbolaget.
Svaranden gjorde å sin sida gällande att inget låneavtal ingåtts och anförde att förlusten av kortet kom till hans kännedom först när han meddelades om utbetalningen från kreditbolaget. Inloggningskortet förvarades under arbetstid i en plånbok som fanns i omklädningsrummet. Samma dag som svaranden fick vetskap om betalningen, fördes pengarna vidare till ett konto hos en annan bank. Då svaranden fick kännedom om detta, kontaktades kreditbolaget omgående och en polisanmälan om bedrägeri upprättades. Svaranden menade att oaktsamhet inte förelegat då varken kännedom om lånet eller utnyttjande av kreditbelopp förekommit. Svaranden har också försökt spärra inloggningskortet snarast möjligt. Till saken hör också att svaranden i ett tidigare mål berättigats en skadeståndsfordran med anledning av att en person dömts för att obehörigen tagit den aktuella krediten i svarandens namn.
Som första fråga prövar Tingsrätten huruvida avtalsgrundad betalningsskyldighet föreligger. Av Tingsrättens domskäl framgår att huvudregeln är att kontoinnehavare inte ansvarar för fordran som uppstår vid obehörigt utnyttjande av betalningsinstrument. Tingsrätten betonade däremot att det är innehavaren av den elektroniska underskriften som behöver göra detta obehöriga utnyttjande antagligt. Svaranden har genom muntlig och skriftlig bevisning lyckats göra det antagligt, varför ersättningsskyldighet inte anses föreligga på grund av avtal. Principen om condictio indebiti kunde inte tillämpas då ett låneavtal ingåtts. Låneavtalet skapar i sig en rättslig grund för utbetalningen. Inga uppgifter har visat att svaranden haft vetskap om eller tillgodogjort sig kreditbeloppet varför principen om obehörig vinst inte aktualiseras. Vad gäller åberopandet av ren förmögenhetsskada tydliggör Tingsrätten att den oaktsamhet som svaranden får anses ha visat genom att inte skydda inloggningskoden eller hålla uppsikt över inloggningskortet strider mot bankens användarvillkor. Dessa villkor kan däremot endast åberopas mellan bank och kund.
Mot bakgrund av ovan ogillades käromålet av Tingsrätten.
På samma grunder som Tingsrätten fastställde Hovrätten att utbetalningen inte varit en misstagsbetalning, då rättslig grund (avtal) funnits mellan bank och lånetecknare. Inte heller condictio indebeti kunde aktualiseras.
Vad gäller obehörig vinst betonade Hovrätten att svaranden, i egenskap av kärande genom en Tingsrättsdom fått en skadeståndsfordran. Detta med anledning av att en person dömts för penningtvättbrott genom att olovligen tagit detta lån i kärandens namn. Kreditbolaget anförde att denna skadeståndsfordran gynnat svaranden ekonomiskt, vilket svaranden bemött med att lånesumman inte kommit honom tillhanda. Kreditbolaget har inte lyckats påvisa obehörig vinst.
Slutligen förtydligade Hovrätten varför skadeståndsskyldighet på grund av ren förmögenhetsskada inte uppkommit. Hovrätten hänvisar då till den praxis som förtydligar när ersättning för ren förmögenhetsskada kan utgå. Den typsituation som skulle kunna ha relevans för målet i fråga är ifall ett handlande varit kvalificerat otillbörligt (jfr NJA 2005 s. 608). Svaranden anses inte ha handlat kvalificerat otillbörligt på ett sådant sätt att ersättning för ren förmögenhetsskada kan utgå.
Mot bakgrund av detta fastställde Hovrätten Tingsrättens dom.
