Schrems II and the Privacy Shield
The Privacy Shield was invalidated from July 16, 2020 as the CJEU concluded that it provided insufficient rights and remedies for EU/EEA citizens.
Although not unexpected, the decision has created a situation where those relying on the Privacy Shield has been forced to reconsider how they should move forward.
One way forward is to use Standard Contractual Clauses (SCCs). But the use of them will be highly impractical and is not a solution for the long term.
Given the current climate for negotiations between the US and the EU a new solution seems highly unlikely in the short term.
Any business that relied on the Privacy Shield should immediately take note and discuss ongoing agreements with an attorney to handle the situation.
